Drivers under 21 and alcohol — California Permit Test
Drivers under 21 and alcohol on the California permit test — 6 rules, each with the reason behind it and a question on it while it is fresh.
The rules
A driver under 21 years old may not carry any alcoholic beverage inside a vehicle unless someone 21 years old or older is with them, and the container must be full, sealed and unopened.
It is not about drinking it. Carrying it at all is the offense for a driver under 21.
You may not carry any alcohol beverage inside a vehicle unless an individual who is 21 years old or older is with you.
If a driver under 21 is caught with alcohol in their vehicle, law enforcement can impound the vehicle for up to 30 days, and the court may fine them and suspend their license for one year.
The car goes for a month and the license for a year, which is a long time at nineteen.
If you are caught with alcohol in your vehicle, law enforcement can impound your vehicle for up to 30 days.
If a driver under 21 has no license yet, the court may ask DMV to delay giving them their first driver’s license for up to one year.
The penalty finds you whether or not you have a license to lose.
If you do not already have a driver’s license, the court may ask DMV to delay giving you your first driver’s license for up to one year.
If an officer suspects a driver under 21 of consuming alcohol, they can require a hand-held breath test, a preliminary alcohol screening, or another chemical test.
The screening happens at the roadside, and the driver does not get to decline it.
If a law enforcement officer suspects you of consuming alcohol,
If a driver under 21 is convicted of a DUI with a blood alcohol concentration of 0.01% or higher, DMV may revoke their driving privilege for one year and they must complete a licensed DUI program.
The number is small enough that a single drink reaches it.
If you are convicted of a DUI with a BAC of 0.01% or higher, DMV may revoke your driving privilege for one year.
If a preliminary alcohol screening shows a driver under 21 has a blood alcohol concentration of 0.05% or higher, the officer may require a breath or blood test, and a later test at that level can bring an arrest and a suspension.
The roadside screening at that level is what turns the stop into an arrest.
If your PAS shows a BAC of 0.05% or higher, the officer may require you to take a breath or blood test.
On the test
May a 19-year-old carry sealed alcohol in their car alone?
No, not without an adult over 21. It is not about drinking it. Carrying it at all is the offense for a driver under 21. California Driver’s Handbook, p.75: “You may not carry any alcohol beverage inside a vehicle unless an individual who is 21 years old or older is with you.”
How this works
Most practice tests hand you a bank of questions and leave the manual somewhere else. This one puts them together.
You read one law and the reason behind it, then answer a question on that law while it is still fresh. Get it right and you move on; get it wrong and you have found the gap while it is cheap to fix, not on the morning of the exam.
Learning one rule at a time, and proving it immediately, is what turns a manual you skimmed into something you actually know — and it makes studying feel like getting somewhere rather than like waiting to find out.
What it costs
- One payment, once — not a subscription. Nothing renews and there is nothing to cancel, for an exam you sit one time.
- Free to start: a 10-question test and the first section of cards. No sign-up and no account.
- Paying opens the rest of the cards, unlimited full-length practice tests, and retests built from exactly the questions you got wrong.
- Every level up to Prepared — 3 tests passed in a row.
- Do the work, fail the real exam, and we refund you.
