The rules
A driver with an alcohol concentration of 0.08 or more is presumed to be driving under the influence.
This is the figure a chemical test is read against, and it is reached sooner than most drivers expect.
An alcohol concentration above 0.05 and below 0.08 is relevant evidence that a driver’s ability is impaired.
Being under the limit is not being in the clear, because impairment can be proved on other evidence.
A driving privilege can be revoked for driving under the influence even when the alcohol concentration is below 0.08.
The offense is impairment rather than a number, so a low reading does not end the matter.
An alcohol concentration of 0.15 or more is an aggravated DUI offense carrying heavier fines and jail.
The penalties step up sharply at this level, so the same night can cost very different amounts.
Any DUI revocation requires completing a prescribed Safety and Treatment program before reinstatement.
Waiting out the revocation is not enough; the program is what stands between the driver and a license.
A driver revoked for two or more DUI offenses within a ten-year period must take part in the interlock program.
