Administrative suspension — Idaho Permit Test

Administrative suspension on the Idaho permit test — 8 rules, each with the reason behind it and a question on it while it is fresh.

The rules

If you are arrested for driving under the influence and fail an evidentiary test by having an alcohol concentration over the legal limit, an officer serves you immediately with a Notice of Suspension.

The notice arrives at the roadside, long before any court date.

a peace officer will serve you immediately with a Notice of Suspension

July 2026 Idaho Driver's Handbook, p.125

You have the right to request an administrative hearing on the suspension within seven days of the date on the notice.

Seven days is short, and missing it means the suspension takes effect unchallenged.

You have the right to request an administrative hearing on the suspension within seven (7) days of the date on the notice of suspension

July 2026 Idaho Driver's Handbook, p.125

The administrative license suspension is a civil penalty, separate from any criminal penalty imposed by the court, and you must comply with it and also appear in court on the criminal DUI charges.

They are two separate proceedings, and winning one does not settle the other.

The ALS penalty is a civil penalty and is separate and apart from any criminal penalties imposed by the court system

July 2026 Idaho Driver's Handbook, p.126

Your notice of suspension becomes effective thirty days after the date you received it.

There is a month between the notice and the suspension, and that month is when a hearing has to be asked for.

Your notice of suspension becomes effective thirty (30) days after the date of service

July 2026 Idaho Driver's Handbook, p.126

For a first failure of the evidentiary test, driving privileges are suspended for ninety days, with absolutely no driving privileges during the first thirty days.

The first month is absolute, so even a restricted permit will not get anyone to work.

your driving privileges will be suspended for a period of ninety (90) days

July 2026 Idaho Driver's Handbook, p.126

During the first thirty days of that ninety-day suspension you have absolutely no driving privileges.

Absolute means no restricted permit of any kind, for any reason.

You will have absolutely no driving privileges during the first thirty (30) days of that ninety (90) day suspension

July 2026 Idaho Driver's Handbook, p.126

You will be required to have an ignition interlock device installed on any vehicle you drive for one year after the end of your suspension period.

The device outlasts the suspension by a year, which is longer than most drivers expect.

You will be required to have an ignition interlock device installed on any vehicle you drive for one (1) year after the end of your suspension period

July 2026 Idaho Driver's Handbook, p.126

A second failure of the test within five years brings a one-year suspension with absolutely no driving privileges of any kind.

The second failure is absolute for the whole year, not just the first month.

Your driving privileges will be suspended for one year with absolutely no driving privileges of any kind for a second failure of the test within five (5) years

On the test

When is an Idaho Notice of Suspension served after a failed evidentiary test?

Immediately, by the peace officer. The notice arrives at the roadside, long before any court date. July 2026 Idaho Driver's Handbook, p.125: “a peace officer will serve you immediately with a Notice of Suspension”

How this works

Most practice tests hand you a bank of questions and leave the manual somewhere else. This one puts them together.

You read one law and the reason behind it, then answer a question on that law while it is still fresh. Get it right and you move on; get it wrong and you have found the gap while it is cheap to fix, not on the morning of the exam.

Learning one rule at a time, and proving it immediately, is what turns a manual you skimmed into something you actually know — and it makes studying feel like getting somewhere rather than like waiting to find out.

What it costs

  • One payment, once — not a subscription. Nothing renews and there is nothing to cancel, for an exam you sit one time.
  • Free to start: a 10-question test and the first section of cards. No sign-up and no account.
  • Paying opens the rest of the cards, unlimited full-length practice tests, and retests built from exactly the questions you got wrong.
  • Every level up to Prepared — 3 tests passed in a row.
  • Do the work, fail the real exam, and we refund you.
