DUI law — Kentucky Permit Test

DUI law on the Kentucky permit test — 7 rules, each with the reason behind it and a question on it while it is fresh.

The rules

In Kentucky a person shall not operate or be in physical control of a motor vehicle with an alcohol concentration of 0.08 or above.

Being in physical control counts, so sitting in the driver's seat with the keys is enough.

In Kentucky, a person shall not operate or be in physical control of a motor vehicle while having an alcohol concentration of 0.08 or above

Kentucky Driver Manual, p.26

A Kentucky driver can still be in violation of the DUI law with an alcohol concentration under 0.08 if there is evidence of impaired driving.

The number is not a safe harbor. Evidence of impairment is enough on its own.

However, you could still be in violation of the law with an alcohol concentration under 0.08 if there is evidence of impaired driving while under the influence of alcohol or other substances.

Kentucky Driver Manual, p.26

Kentucky's DUI law also covers driving under the influence of a controlled substance or any other substance that impairs driving ability.

Alcohol is only one way to break this law. Anything that impairs driving counts.

The court costs are on top, and they are often larger than the fine itself.

Kentucky law states in KRS 189A.010 if you are found guilty of an alcohol violation and it is your first conviction within a ten (10) year period, you will be fined not less than $200 nor more than $500 plus court costs

Kentucky Driver Manual, p.27

A first Kentucky DUI conviction within ten years carries imprisonment of not less than forty-eight hours nor more than thirty days.

your license suspended for four (4) to six (6) months.

Kentucky Driver Manual, p.27

For a Kentucky person under the age of eighteen, the DUI license suspension may be longer.

The youngest drivers lose the license for the longest, which is the opposite of what most expect.

On the test

At what alcohol concentration is a Kentucky driver in violation of the DUI law?

0.08 or above. Being in physical control counts, so sitting in the driver's seat with the keys is enough. Kentucky Driver Manual, p.26: “In Kentucky, a person shall not operate or be in physical control of a motor vehicle while having an alcohol concentration of 0.08 or above”

How this works

Most practice tests hand you a bank of questions and leave the manual somewhere else. This one puts them together.

You read one law and the reason behind it, then answer a question on that law while it is still fresh. Get it right and you move on; get it wrong and you have found the gap while it is cheap to fix, not on the morning of the exam.

Learning one rule at a time, and proving it immediately, is what turns a manual you skimmed into something you actually know — and it makes studying feel like getting somewhere rather than like waiting to find out.

What it costs

  • One payment, once — not a subscription. Nothing renews and there is nothing to cancel, for an exam you sit one time.
  • Free to start: a 10-question test and the first section of cards. No sign-up and no account.
  • Paying opens the rest of the cards, unlimited full-length practice tests, and retests built from exactly the questions you got wrong.
  • Every level up to Prepared — 3 tests passed in a row.
  • Do the work, fail the real exam, and we refund you.
