Test refusal — Maine Permit Test
Test refusal on the Maine permit test — 5 rules, each with the reason behind it and a question on it while it is fresh.
The rules
If you refuse an alcohol test, your license is immediately suspended by the Secretary of State for up to 6 years.
If refusing cost less than failing, every drunk driver would refuse.
The suspension will be for a period of up to six years by the Secretary of State.
A refusal suspension is administrative, which means no court action is necessary.
A driver hoping to keep driving until a judge rules finds the license is already gone.
It is an administrative suspension - that means no court action is necessary.
The arresting officer's testimony about your driving can bring an OUI conviction even without alcohol test results.
A driver who refuses the test thinking there will be no proof can still be convicted on what the officer saw.
In addition, testimony of the arresting police officer regarding your driving performance can result in an OUI conviction even without the alcohol test results to back it up!
The administrative suspension from the Secretary of State stays in effect even if you are later found innocent of OUI.
A driver who refuses and then wins in court still has no license for the refusal.
The administrative suspension issued by the Secretary of State remains in effect even if you are later found innocent of OUI.
If you refuse a test and are found guilty on the officer's testimony, the judge treats the refusal as an aggravating factor and adds another OUI suspension.
Refusing to dodge the evidence ends up costing a longer penalty than taking the test would have.
Also, if you are found guilty based on the police officer's testimony, your refusal to take a test will be considered as an aggravating factor by the judge and another OUI suspension will be tacked on, so you will have a much longer penalty than if you had submitted to the test.
On the test
For up to how long can the Secretary of State suspend a license for refusing an alcohol test?
6 years. If refusing cost less than failing, every drunk driver would refuse. Maine Driver’s License Manual, p.31: “The suspension will be for a period of up to six years by the Secretary of State.”
How this works
Most practice tests hand you a bank of questions and leave the manual somewhere else. This one puts them together.
You read one law and the reason behind it, then answer a question on that law while it is still fresh. Get it right and you move on; get it wrong and you have found the gap while it is cheap to fix, not on the morning of the exam.
Learning one rule at a time, and proving it immediately, is what turns a manual you skimmed into something you actually know — and it makes studying feel like getting somewhere rather than like waiting to find out.
What it costs
- One payment, once — not a subscription. Nothing renews and there is nothing to cancel, for an exam you sit one time.
- Free to start: a 10-question test and the first section of cards. No sign-up and no account.
- Paying opens the rest of the cards, unlimited full-length practice tests, and retests built from exactly the questions you got wrong.
- Every level up to Prepared — 3 tests passed in a row.
- Do the work, fail the real exam, and we refund you.
