DUI legal limits — North Dakota Permit Test

DUI legal limits on the North Dakota permit test — 3 rules, each with the reason behind it and a question on it while it is fresh.

The rules

In North Dakota, a driver age 21 or older is legally under the influence with an alcohol concentration of .08% or greater.

At this level reaction time, vision and judgment are clearly impaired for almost everyone.

If a chemical test reveals that you have eight one-hundredths of one percent (.08%) or greater of alcohol in your blood, or .02% if under the age of 21, you are considered legally to be under the influence of alcohol.

A driver under age 21 is considered legally under the influence of alcohol at .02% or greater.

Young drivers are new to both driving and drinking, so the law allows close to zero alcohol.

If a chemical test reveals that you have eight one-hundredths of one percent (.08%) or greater of alcohol in your blood, or .02% if under the age of 21, you are considered legally to be under the influence of alcohol.

There are two separate penalties under the DUI law, an administrative license penalty and a court conviction penalty, and your driving privileges may be suspended through either or both.

Beating the charge in court does not save your license, because the license action runs on its own track.

One is an administrative license penalty, the other is a court conviction penalty.

On the test

For a driver 21 or older, what is the lowest alcohol concentration at which North Dakota considers them legally under the influence?

.08%. At this level reaction time, vision and judgment are clearly impaired for almost everyone. North Dakota Noncommercial Driver License Manual, p.36: “If a chemical test reveals that you have eight one-hundredths of one percent (.08%) or greater of alcohol in your blood, or .02% if under the age of 21, you are considered legally to be under the influence of alcohol.”

How this works

Most practice tests hand you a bank of questions and leave the manual somewhere else. This one puts them together.

You read one law and the reason behind it, then answer a question on that law while it is still fresh. Get it right and you move on; get it wrong and you have found the gap while it is cheap to fix, not on the morning of the exam.

Learning one rule at a time, and proving it immediately, is what turns a manual you skimmed into something you actually know — and it makes studying feel like getting somewhere rather than like waiting to find out.

What it costs

  • One payment, once — not a subscription. Nothing renews and there is nothing to cancel, for an exam you sit one time.
  • Free to start: a 10-question test and the first section of cards. No sign-up and no account.
  • Paying opens the rest of the cards, unlimited full-length practice tests, and retests built from exactly the questions you got wrong.
  • Every level up to Prepared — 3 tests passed in a row.
  • Do the work, fail the real exam, and we refund you.
