Teen driver seat belt — South Dakota Permit Test

Teen driver seat belt on the South Dakota permit test — 3 rules, each with the reason behind it and a question on it while it is fresh.

The rules

Under SDCL 32-37-1.2, any operator who is at least 14 and under 18 years old must wear a properly adjusted and fastened seat belt whenever the vehicle is in motion.

New teen drivers crash most often, and a belt is what keeps them in the seat when they do.

Any operator of any passenger vehicle operated on a public street or highway in this state, who is at least fourteen years of age and under eighteen years of age, shall wear a properly adjusted and fastened safety seatbelt system, required to be installed in the passenger vehicle if manufactured pursuant to Federal Motor Vehicle Safety Standard Number 208 (49 C.F.R. 571.208) in effect January 1, 1989, always when the vehicle is in motion.

The child restraint and seat belt rules in SDCL 32-37 do not apply in passenger cars made before 1966 that have not been equipped with seat belts.

A car with no belts cannot be used to meet a belt law, so the law exempts it.

The provisions of 32-37-1, 32-37-1.1, 32-37-1.2, and 32-37-1.3 do not apply in passenger cars manufactured before 1966 that have not been equipped with seatbelts.

Failing to comply with South Dakota’s child restraint chapter is not considered contributory negligence and is not admissible as evidence in a civil trial.

Without this rule, a crash victim’s missing car seat could be used to cut what the other driver owes.

Failure to comply with the provisions of this chapter is not considered as contributory negligence, comparative negligence or assumption of the risk and is not admissible as evidence in the trial of any civil action.

On the test

Under SDCL 32-37-1.2, when must a driver aged 14 to under 18 wear a seat belt?

Always when the vehicle is in motion. New teen drivers crash most often, and a belt is what keeps them in the seat when they do. South Dakota Driver License Manual, p.27: “Any operator of any passenger vehicle operated on a public street or highway in this state, who is at least fourteen years of age and under eighteen years of age, shall wear a properly adjusted and fastened safety seatbelt system, required to be installed in the passenger vehicle if manufactured pursuant to Federal Motor Vehicle Safety Standard Number 208 (49 C.F.R. 571.208) in effect January 1, 1989, always when the vehicle is in motion.”

How this works

Most practice tests hand you a bank of questions and leave the manual somewhere else. This one puts them together.

You read one law and the reason behind it, then answer a question on that law while it is still fresh. Get it right and you move on; get it wrong and you have found the gap while it is cheap to fix, not on the morning of the exam.

Learning one rule at a time, and proving it immediately, is what turns a manual you skimmed into something you actually know — and it makes studying feel like getting somewhere rather than like waiting to find out.

What it costs

  • One payment, once — not a subscription. Nothing renews and there is nothing to cancel, for an exam you sit one time.
  • Free to start: a 10-question test and the first section of cards. No sign-up and no account.
  • Paying opens the rest of the cards, unlimited full-length practice tests, and retests built from exactly the questions you got wrong.
  • Every level up to Prepared — 3 tests passed in a row.
  • Do the work, fail the real exam, and we refund you.
