Legal limits — Texas Permit Test

Legal limits on the Texas permit test — 9 rules, each with the reason behind it and a question on it while it is fresh.

The rules

In Texas a person aged 21 and over is legally intoxicated with a blood alcohol concentration of 0.08 or more.

It is the number the whole adult offense turns on. Below it a driver can still be charged on the way they were driving.

In Texas, a person, age 21 and over, is considered legally intoxicated if the person has a BAC of 0.08 or more

Texas Driver Handbook, p.55

The legal limit in Texas is a blood alcohol concentration of 0.08, or any amount that results in the loss of normal use of mental or physical faculties.

A driver under the number can still be over the line. The second half of the rule is what catches that.

The legal limit in Texas is 0.08 BAC or any amount which results in the loss of normal use of mental or physical faculties

Texas Driver Handbook, p.58

Texas law does not allow any amount of blood alcohol concentration for minors.

There is no allowance to argue over for a driver under 21. Detectable is the offense.

It takes about one hour for the body to rid itself of each drink consumed.

Nothing shortens it. That is what makes waiting the only thing that works.

drinks, and food intake can minimize the effects of alcohol. It takes about one hour for the body to rid itself of each drink consumed

Texas Driver Handbook, p.56

Taking cold showers, drinking black coffee, or exercising will not make a person sober; only time can minimize the effects of alcohol.

Every folk remedy on the list makes somebody feel better and none of them changes the blood. The clock is the only thing that does.

Taking cold showers, drinking black coffee, or exercising will not make a person sober. Only time, based on body weight, number of drinks, and food intake can minimize the effects of alcohol

Texas Driver Handbook, p.56

A drink may be a 12 ounce can of beer, a mixed drink with 1.5 ounces of liquor, or a 5 ounce glass of wine, and they all contain about the same amount of alcohol.

People count glasses rather than alcohol, and the glasses are not the same size. The amounts are set to match.

Food intake, medications, health, gender, and psychological conditions all affect the rate of alcohol absorption, so alcohol tolerance varies by individual.

The chart is an average of people who are not you. Two people with the same drinks can be far apart.

Texas Driver Handbook, p.58

It is illegal to possess an open container of alcohol in the passenger area of a motor vehicle on a public highway, whether the vehicle is being driven, stopped, or parked.

Parking the car does not make the open bottle lawful. The offense is where the container is, not what the car is doing.

It is illegal to possess an open container of alcohol in a motor vehicle passenger area located on a public highway, regardless of whether the vehicle is being operated, stopped, or parked

Texas Driver Handbook, p.56

Conviction for possessing an open container of alcohol in a vehicle is punishable by a fine not to exceed $500.

It is a small fine beside the rest of this chapter. It is also the easiest of these offenses to commit by accident.

On the test

At what blood alcohol concentration is a Texas adult legally intoxicated?

0.08 or more. It is the number the whole adult offense turns on. Below it a driver can still be charged on the way they were driving. Texas Driver Handbook, p.55: “In Texas, a person, age 21 and over, is considered legally intoxicated if the person has a BAC of 0.08 or more”

How this works

Most practice tests hand you a bank of questions and leave the manual somewhere else. This one puts them together.

You read one law and the reason behind it, then answer a question on that law while it is still fresh. Get it right and you move on; get it wrong and you have found the gap while it is cheap to fix, not on the morning of the exam.

Learning one rule at a time, and proving it immediately, is what turns a manual you skimmed into something you actually know — and it makes studying feel like getting somewhere rather than like waiting to find out.

What it costs

  • One payment, once — not a subscription. Nothing renews and there is nothing to cancel, for an exam you sit one time.
  • Free to start: a 10-question test and the first section of cards. No sign-up and no account.
  • Paying opens the rest of the cards, unlimited full-length practice tests, and retests built from exactly the questions you got wrong.
  • Every level up to Prepared — 3 tests passed in a row.
  • Do the work, fail the real exam, and we refund you.
