DUI arrest procedures — Delaware Permit Test

DUI arrest procedures on the Delaware permit test — 3 rules, each with the reason behind it and a question on it while it is fresh.

The rules

At a Delaware DUI arrest, the officer confiscates the driver's license (except an out-of-state license) and issues a 15-day temporary license.

Taking the license at the scene keeps an impaired driver from getting back in the car that night.

The officer will then issue a 15-day temporary license.

Delaware Driver Manual, p.55

A driver arrested for DUI in Delaware has 15 days to request an administrative hearing, and the license is revoked at the end of the 15 days if no hearing is requested.

A driver who sets the paperwork aside loses the license automatically, without ever being heard.

The license will be revoked at the end of the 15-day period if no hearing is requested.

Delaware Driver Manual, p.55

Delaware's Motor Vehicle Administrative Hearing decides whether the officer had probable cause, whether the evidence shows the driver was under the influence, and whether the driver refused a chemical test after being told the penalty.

A hearing that checks the officer's reasons protects a driver who was stopped without good cause.

Whether a police officer had probable cause to believe that the driver was driving, operating, or had actual physical control of a vehicle while under the influence of alcohol and/or drugs.

On the test

After taking the license at a Delaware DUI arrest, what temporary license does the officer issue?

A 15-day temporary license. Taking the license at the scene keeps an impaired driver from getting back in the car that night. Delaware Driver Manual, p.55: “The officer will then issue a 15-day temporary license.”

How this works

Most practice tests hand you a bank of questions and leave the manual somewhere else. This one puts them together.

You read one law and the reason behind it, then answer a question on that law while it is still fresh. Get it right and you move on; get it wrong and you have found the gap while it is cheap to fix, not on the morning of the exam.

Learning one rule at a time, and proving it immediately, is what turns a manual you skimmed into something you actually know — and it makes studying feel like getting somewhere rather than like waiting to find out.

What it costs

  • One payment, once — not a subscription. Nothing renews and there is nothing to cancel, for an exam you sit one time.
  • Free to start: a 10-question test and the first section of cards. No sign-up and no account.
  • Paying opens the rest of the cards, unlimited full-length practice tests, and retests built from exactly the questions you got wrong.
  • Every level up to Prepared — 3 tests passed in a row.
  • Do the work, fail the real exam, and we refund you.
