Implied consent law — Delaware Permit Test
Implied consent law on the Delaware permit test — 3 rules, each with the reason behind it and a question on it while it is fresh.
The rules
Under Delaware's implied consent law, anyone arrested for DUI is deemed to have given consent to a chemical test of their breath, blood, and/or urine.
Without it, a drunk driver could simply say no and leave no proof of how impaired they were.
Anyone arrested for driving, operating, or having actual physical control of a vehicle, an off-highway vehicle, or a moped, while under the influence of intoxicating liquor or of any drug shall be deemed to have given consent to submit to a chemical test or tests or their breath, blood, and/or urine for the purpose of determining the alcohol content in their blood.
If a person arrested for DUI in Delaware refuses the test the officer designates, reasonable steps can be taken to conduct tests without the person's consent.
A driver who refuses the test should not be able to hide the evidence of a crash they caused.
If the person refuses to submit to the test designated by the officer, reasonable steps can be taken to conduct tests without the person’s consent.
After a chemical test refusal, Delaware's Division of Motor Vehicles may revoke the person's license and/or driving privilege for one to two years, depending on prior offenses.
If refusing cost less than failing, every drunk driver would refuse.
Upon such refusal the arresting officer will deliver a report of refusal to the Division of Motor Vehicles who may revoke the person’s driver license and/or driving privilege for one to two years depending on the number of previous DUI offenses, probable cause, and/or chemical test refusal offenses.
On the test
Under Delaware's implied consent law, what is a person arrested for DUI deemed to have agreed to?
A breath, blood or urine test. Without it, a drunk driver could simply say no and leave no proof of how impaired they were. Delaware Driver Manual, p.54: “Anyone arrested for driving, operating, or having actual physical control of a vehicle, an off-highway vehicle, or a moped, while under the influence of intoxicating liquor or of any drug shall be deemed to have given consent to submit to a chemical test or tests or their breath, blood, and/or urine for the purpose of determining the alcohol content in their blood.”
How this works
Most practice tests hand you a bank of questions and leave the manual somewhere else. This one puts them together.
You read one law and the reason behind it, then answer a question on that law while it is still fresh. Get it right and you move on; get it wrong and you have found the gap while it is cheap to fix, not on the morning of the exam.
Learning one rule at a time, and proving it immediately, is what turns a manual you skimmed into something you actually know — and it makes studying feel like getting somewhere rather than like waiting to find out.
What it costs
- One payment, once — not a subscription. Nothing renews and there is nothing to cancel, for an exam you sit one time.
- Free to start: a 10-question test and the first section of cards. No sign-up and no account.
- Paying opens the rest of the cards, unlimited full-length practice tests, and retests built from exactly the questions you got wrong.
- Every level up to Prepared — 3 tests passed in a row.
- Do the work, fail the real exam, and we refund you.
